The 3 Step Process
Under the current law, the procedure to evict a tenant involves a 3 stage process:
1. Notice
The first step of the legal process to evict a tenant will be to draft and serve the necessary legal notice on your tenant asking them to leave the property. You can serve a Section 21 Notice or a Section 8 Notice.
2. Court Order to Evict the Tenant
If the tenant fails to comply with the eviction notice served, we will then draft and prepare the necessary court papers and apply for a court order to evict the tenant. This is called a Possession Order. There may be a court hearing.
3. Bailiffs
If the tenant fails to vacate the property by the specified date in the Possession Order, we will obtain a warrant for possession and instruct Bailiffs who will physically evict the tenants from the property.
